OPPOSE: SB283 “Domestic Partnership Act”

SB283: A “Marriage” by any other name is still a “Marriage”.
From the bill: Sec. 7. (1) “Domestic partners have the same rights, protections and benefits, and are subject to the same responsibilities, obligations and duties under law, whether derived from statutes, administrative regulations, court rules, government policies, common law or any other provisions or sources of law, as are granted to and imposes upon spouses.”
This includes: laws concerning property, death, children, “divorce or end to domestic partnership”, etc. It also prohibits “discrimination” by public agencies, in other words, they can’t treat domestic partners any different than a “spouse” or “spouses.”
This bill establishes a domestic partnership as a new type of civil contract recognized in the State of Nevada. Domestic partners must file with the Secretary of State a notarized statement and pay a fee.
Sec. 7 (9) “Where necessary to protect the rights of domestic partners pursuant to this chapter, gender-specific terms referring to spouses must be construed to include domestic partners.”
Sec. 7 (10) (d) “Other rights and duties as between the partners concerning ownership of property, and reference to the date of a marriage shall be deemed to refer to the date of registration of the domestic partnership.”
Sec. 10 “A domestic partnership is not a marriage for the purposes of Section 21 of Article 1 on the Nevada Constitution.” See the complete bill at: http://www.leg.state.nv.us/75th2009/Bills/SB/SB283.pdf
Article 1 Section 21 was passed by the people in 2000 and 2002 by 70%. From the Nevada Constitution: Art. 1 Sec: 21. “Limitation on recognition of marriage. Only a marriage between a male and female person shall be recognized and given effect in this state.”
SB283 completely circumvents the will of the people! A marriage by any other name is still a marriage.
