Support AJR5 Provides that the Legislature may call, under extraordinary circumstances, a special session. Now, only the Governor may call a special session. This Constitutional change provides for a potential check on the Governor by the Legislature, if he refuses to call a special session. It creates a very high bar in that the Legislature can only call a special session if 2/3rds of the Legislators of both houses sign a petition specifying the business to be transacted in the special session. The special session is limited to 20 days.
We feel that is it important under extraordinary circumstances to give the Legislature the power to call its self into special session. For instance, under a state or national emergency, the Governor can act as a virtual dictator when the Legislature is not in session. This was highlighted legislatively several years ago when we opposed the Nevada version of the Model Emergency Health Powers Act, which specifically made the Governor a dictator during a crisis. In this legislation, which we did defeat, the Governor could have confiscated food, fuel, vehicles, property, supplies and even guns without any oversight by the Legislature. Checks and balances are important and this is an important check and balance.
