SB52 REAL ID Passes Committee

The Senate Energy, Infrastructure and Energy Committee passed SB52: 5 Yeah, 2 No this morning.  SB 52 will now go to the Senate Floor.

 You can view a letter from the Governor of South Carolina, Mark Sanford written on March 31, 2008 outlining his concerns with REAL ID on our website. See synopsis below.   http://www.nevadafamilies.org/2009_nevada_legislature_alerts.htm   South Carolina, like Arizona and eight other states, has passed legislation prohibiting the implementation of Real ID.  Below is a summary of his enlightening letter.

 He states that without prompting from the Federal Government S. Carolina has established one of the most secure driver’s licenses in the county and mentions numerous security features implemented.

*       He makes it clear that S. Carolina is already in compliance with 90 percent of Real ID requirements.

*       He is encouraged by the fact the Dept. of Homeland Security has decided to treat the citizens of States, including Montana, that have laws preventing them from complying with REAL ID, the same as citizens of other states that have agreed to comply with REAL ID. 

*       He requests that DHS will treat S. Carolina like Montana and not penalize her citizens and will allow them to travel and enter federal buildings like the citizens of all other states.

*       He mentions his reservations about REAL ID.

1)        Including that there was no national debate about the national policy change to create a de facto national ID system with REAL ID.

2)       That REAL ID was classified by the bipartisan National Conference of State Legislatures as “the most egregious example” of an unfunded federal mandate, where the Federal government is paying only 2 percent of the cost. He says that in its present form REAL ID will cost S. Carolina $116 million. He says the DHS is now taking money from existing Homeland Security grants to make funds available for grants to help in implementing REAL ID.

3)       He states that REAL ID will substantially raise wait times at DMV offices across S. Carolina from 15 minutes up to 1-2 hours.

4)       REAL ID upsets the balance of power between the federal Government and the states by coercing the states into creating a national ID system for federal purposes. A citizen could not enter a federal building to speak to their US Congressman without REAL ID. REAL ID provides substantial discretion to expand the scope of REAL ID. He states, ”…we have no assurances that at some point we won’t need a REAL ID to open a bank account or purchase a gun.

5)       REAL ID requires the creation of a national computer network of driver’s license databases that can be accessed by all states and the federal government.  This will be, in effect, a central depository of citizens’ personal information. Does it really make sense to put all this information into a central database rather than have this information housed independently across fifty states?  What about privacy?

6)       REAL ID provides no guarantees that it will make us any safer. In a recent U.S. Court of Appeals for the Ninth Circuit case, it was conceded that a person doesn’t need any identification to fly, as long as they are subject to alternative screening.

 Our request to the Legislature is that they stop Nevada’s DMV from continuing its departmental effort to comply with REAL ID, vote NO on SB52, and then prohibit Nevada from participating in REAL ID, like Arizona, South Carolina, Montana, Washington, Idaho, Oklahoma, Louisiana, Georgia, Maine, and New Hampshire.
