Voter Guide Candidate Questionnaire and Responses

County Sheriff

1) Do you support laws and regulations to insure that illegal aliens cannot obtain a Nevada Drivers’ License (de facto citizenship)?

 2) Citizens are suffering with the increase in gangs, crime and drugs because of national open borders.

The 1996 Illegal Immigration Reform and Immigrant Responsibility Act allows the federal government and local police to work together under specific written agreements, which provide state and local law enforcement with more authority to detain illegal aliens. Will you work with federal authorities to detain and deport illegal aliens who commit crimes?

 3) Do you support legislation to stop illegal aliens from receiving Nevada taxpayer-funded services?

5) Do you support the unabridged individual Constitutional right of Citizens to Keep and Bear Arms?

6) Statistics throughout the United States consistently show that the fewer the restrictions on gun ownership and concealed carry the lower the crime rate and the safer the community. http://www.eagleforum.org/psr/2000/june00/psrjune2000.html Do you support Vermont style legislation that would eliminate requirements to pay fees and register gun owners and simply allow law-abiding citizens to carry firearms openly or concealed?

7) Do you believe that peace officer status in this state can only be granted to federal employees, like the BLM, if they are specifically authorized by state law; otherwise they must contract with the County Sheriff? 

8) The federal government claims control over 91% of Nevada's land. Nevada has never ceded criminal jurisdiction except for federal lands constitutionally held under exclusive federal jurisdiction or ceded to it by the state. Do you support maintaining Nevada's criminal jurisdiction over Nevada's lands?

9) In 2005, the Nevada Legislature passed legislation requiring that before any property/livestock could be seized that there had to be a decision rendered by a court of competent jurisdiction. This was in response to recent confiscations by the Bureau of Land Management. Do you support this legislation and will you insure that citizens in your county have due process and a court order before any property/livestock are seized?

11) The US Congress passed the Real ID Act of 2005, an un-funded mandate, turning state driver’s licenses into de facto national ID cards creating a national ID system. Real ID requires an RFID chip be placed in state drivers licenses. The New Hampshire House of Representatives rejected implementation of the federal mandate citing privacy concerns. Do you oppose turning state drivers’ licenses into de facto national ID cards?

12) The Fourth Amendment to the US Constitution and Art. 1 Sec. 18 of the Nevada Constitution protects the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures and that no warrant shall be issued without probable cause…Since the passage of the so-called US PATRIOT Act this constitutionally protected right is in jeopardy. Will you insure that in your county legal search warrants are obtained by law enforcement?

13) The National Animal Identification System (NAIS) will require RFID chips for all agricultural animals and pets. It will allow search and seizure for animal control without search warrants. Will you oppose any state or county legislation, which would allow state or county agencies and law enforcement to participate in or police the NAIS system for the federal government?

14) In 2004, petitioners were arrested by Reno Police on public property in violations of NRS 293.127565 The petitioners were exonerated in the municipal, district and Nevada Supreme courts. Will you work to protect the first amendment rights of speech and petition in your jurisdiction?

15) Federal money means federal mandates. Are you concerned about federal influence and interference with local law enforcement?
